The Gambling Machine's transformation into Daily Fantasy Sports

  1. betting been around for long time. Vegas pretty much has monopoly because sports gambling is illegal in 46/50 states
    1. Leads to underground illegal gambling
    2. People use intermediaries of Vegas to place and collect bets
  2. Still remained strong force of the Gambling assemblage
    1. Machine adapted, as Guittari hypothesizes, to explore its virtual possibilities within society
    2. The Unlawful Internet Gambling Enforcement Act of 2006 (UIGEA) attempted to shut down the difference the machine was exploring…gambling in the new, unregulated space of the internet
i.The UIGEA defined gambling as something where the outcome is the result of pure chance, and skill does not increase one’s odds of winning.
ii.Online poker sites became part of the gambling machinic assemblage until they were deemed to not be protected by UIGEA under the skill category. The machine continued to adapt
  1. DFSs were created drawing on much of the same user base from poker gamblers and also brought in a new market place for fantasy sports.
iii.Abstract machine realized that year-long fantasy sports were protected from UIGEA because skill proved to correlate with success
  1. Gambling not really a worry with year-long leagues as it is a one time, thus low volume, transaction.
  2. Gambling machine wanted more, led to the creation of Daily Fantasy Sports
    1. Covered under fantasy sports argument for now but allows for high volume diverse platform “gambling” that year-long fantasy sports lacked
  3. New York first state to fight DFS and claim that they are in fact sports gambling and should not be protected under UIGEA like year-long fantasy sports are.
The inability for the UIGEA legislation to adapt like the machinic assemblage of gambling allowed for DFS to thrive.
