Again the settler state is intervening as one with “jurisdiction over” Native nations and communities, all while refusing to recognize their own litigation as integral to the disruption of “Indian communities and families." The settler state makes all claims in ICWA on the grounds that it is the ultimate parent who must proceed over its children as God does over His subjects--thereby reifying white European lineages of sovereignty which sees people as constituents subject to rule.
