The Importance of Bail Bonds

The purpose of setting bail is to ensure that the defendant will return to court on the ordered dates and hearings. As the agents from Marvin Morgan's bail bonds company inform, bail can be in form of a cash, property or bond, and in case the defendant fails to appear to his appointed hearings, the court gets to keep it. Within the United States there are some standard practices that judges follow when setting a bail amount.  There are also several factors that courts usually take into consideration when determining bail conditions.

In most cases, accused individuals or defendants, can be released from jail immediately after posting bail.  However, if a person is accused of a more serious crime, courts have the right to deny bail and keep the defendant imprisoned until the official trial or hearing.  The weight of the evidence, the defendant’s ties and relationships in the community, his past and present conduct, probability of danger, flight risk, probability of endangering victims or witnesses, whether the defendant’s source of funds are related to the a criminal activity, length of residence in the community, and employment history and just some of the key factors.

Apart from these, courts and judges are allowed to look into, and consider any other factors that they may find relevant. In most states, the law requires that once a person has been arrested, he or she must be brought before of a judge within a period of 24 hours. As Marvin Morgan's Bail Bonds agents explain, this initial appearance in front of a judge is known as a Magistrate Court. This is the time when the judge has to determine whether he is going to detain the defendant or not. In case the judge concludes that there is a cause, based on the factors stated above, then the next step is for the judge to set the bail amount. This is an important part of the process, as it determines the defendant’s freedom during the pending case. In order to protect the citizens’ rights in the bail proceedings, the Eighth Amendment of the U.S. Constitution stipulates that bail cannot be excessive.
